A prisoner in the San
Sebastián jail in San
José has presented a
claim of
unconstitutionality
against the jail that
will not allow him to
have "visitas conyugale"
- conjugal visits - with
partners of the same
sex.
Manuel Morales Urbina,
filed a claim with the
Sala Constitucional
(Constitutional Court),
citing article 66 of the
Reglamento Técnico
Penitenciario is
discriminatory.
Urbina says the article
allows a prisoner to
have intimate contact
with a person of his or
her choice but does not
distinguish that is has
to be of the opposite
sex.
The court will have 30
days to decide on the
