Fiscal General Says Has Not Even Seen the Case Files Against Former Presidents Calderón and Rodríguez
In the event he is elected to magistrate of the Sala III, Fiscal General Francisco Dall’Anese, assures that he will not intervene in the cases against former presidents, Rafael Ángel Calderón and Miguel Ángel Rodríguez, who will have their date in court for accepting bribes, among other charges.

Dall’Anese made his application minutes before the deadline on Friday to be appointed to the court bench. He is vying for the sport being left vacant by retiring magistrate, Rodrigo Castro, with 10 other candidates.

"In those case files I have not even seen them, not even the cover. It would be unethical", said Dall’Anese to Spanish language newspaper Al Día reporter Alejandro Vargas.

"If one has acted as a prosecutor or judge in a case, they have to excuse themself in any type of court process", Said Dall’Anese, referring to his temporary calls to the court as a substitute and his position of chief prosecutor.

The Fiscal said that, if appointed to the bench, he would ask for a substitute to take his place when dealing with cases he has been involved in as Fiscal or Judge, especially in the cases against the former presidents.

Dall’Anese did not give further comments on his decision to aspire for a position on the high court bench, other than saying that this is an opportunity that does not come very often and he cannot pass it up.

If he is appointed to the bench, he will be required to resign as Fiscal General, which terms is due to end in eleven months. If he loses the appointment, Dall’Anese said he would seek a second term as Fiscal.
