Court Ruling Puts Brakes
On Intersectoral Buses
The yellow buses that
were to have been
operating the seven "interlinea"
beginning tomorrow will
stay put in the La Uruca
parking lot while
authorities sort out the
legal problems following
a court ruling made
public yesterday.
The interlinea route are
seven interesectoral
routes that take
passengers from one
community to another,
without the need of
transfer buses in
downtown San José.
A decision by the
Tribunal Administrativo
de Transportes has
effective put the brakes
on the rolling of the
buses tomorrow
(Saturday).
The Tribunal, in its
decision, said it noted
a number of
irregularities in the
adjudication of the
concession who will
operate the 100 buses
along the seven routes,
which was awarded by the
Consejo de Transportes
Públioc (CTP) to
Transporte Sectorial MPT
S.A.
The court ruling is
known as 1696-2008 came
after an appeal by the
Barrantes Araya S.A bus
company lost its bid for
the concession.
The court sided with
Barrantes that
irregularities were
found in the bidding
process and the CTP was
advised not to go ahead
with the route until the
court heard the appeal.
The first doubts raised
by the appeal was the
family ties between
members of the CTP and
partners and directors
of the Transporte
Sectorial MPT S.A, a
consortium made up of
several different bus
operators.
The court heard the
arguments that the MPT
proposal for the
financial,
administration and legal
operation of the bus
company was presented by
Iván Moya Acuña, who is
son of Ana Isabel Mayela
Acuña Martínez, who is
the wife of Rafael Chan
Jaén, the right hand man
of the president of the
CTP, the viceministra of
the Ministerio de Obras
Pública y Tranportes,
Viviana Martín.
However, the family ties
don't stop at that. The
court found that another
member of the CTP, Sara
Virginia Corrales
Corrales, has family
members linkes to the
interlinea
concessionaire. A member
of the MPT consortium is
Mario Bermúdez Fallas,
representing the
Autotransportes de
Desamparados S.A. bus
company, who is the
husband of Gledys
Corrales Corrales, the
sister of Sara Virginia.
But, even more
interesting is the fact
that Jorge Herrera
Ocampo, who in addition
to being a member of the
CTP, also has ties to
Coopana RL, an integral
member of the MPT
consortium.
According to the
Autoridad Reguladora de
los Servicios Públicos (Aresep)
the MPT was to have
begun operation with 60
brand new buses and the
rest used, which are
being pulled from the
fleet of the MPT
consortium members.
CTP president Viviana
Martín was not available
for comment and a
statement is to be made
public today by MOPT
minister, Karla González,
detailing the situation
and a possible solution.
In the meantime, the
thousands who had been
planning on using the
new service on Monday
for their ride to and
from work, will have to
wait a little longer.
