First Trial of New Ley
de
Tránsito Today
At 5:30pm today, a woman
will be the first driver
to face a trial under
the new Ley de Tránsito
for drunk driving. The
woman identified by her
last name Acuña Aguilar
will face the judges of
the Tribunal de Juicio
de Flagrancia, located
on the third floor of
the Tribunales de
Goicoechea, San José.
Although other drivers
have been sentenced for
drunk driving by
pleading guilty, Acuña
will be first trial
under the new law.
According to the Poder
Judicial, Acuña was
detained on January 1,
2009, at 5:30pm in Santa
Ana, at the Delegación
de la Fuerza Pública
(police station),
driving intoxicated. The
offices at the station
called on the Policía de
Tránsito who
administered a
breathalyzer test and
found the woman with a
2.24 blood alcohol
content reading.
Under the new Ley de
Tránsito a person with a
blood alcohol content of
0.75 or greater or
driving over 150 Km/h
can face a jail term in
addition of losing their
vehicle and driver's
license. The new law
allows judges to
sentence a first time
offender to between 200
and 950 of community
service in lieu of
prison.
