Constitutional Court dismisses appeal by transsexual seeking gender reassignment surgery under public health
June 16th, 2015 (InsideCostaRica.com) Costa Rica’s Constitutional Court has dismissed an appeal by a person who identifies as a woman that sought coverage from Costa Rica’s public health system (CCSS) to transform her male genitalia into that of a woman.
On April 28th, the transsexual woman filed an appeal with the Constitutional Court in which she sought payment from CCSS in order to have a sex-change procedure in Thailand, as the CCSS does not have specialists to perform such procedures. The woman said that lack of availability of the procedure violated her fundamental rights.
Judges on Friday however dismissed the appeal, concluding there was no scientific evidence that the procedure was medically urgent.
The CCSS is generally required to pay for medical procedures abroad when deemed medically urgent by a medical panel and qualified specialists are not available in the country.
