Municipal Employee Fired For Being Colombian
The Sala II de la Corte Suprema de Justicia confirmed that the tax administrator for the Municipalidad de Santa Ana, Álvaro Manuel Alcalá Segovia, was fired by the former mayor of Santa Ana, María Eugenia Vargas Solís, for simply being a Colombian refugee in Costa Rica.

The court order the municipality to pay Segovia his back salary, including bonuses, vacations and aguinaldo, since he was fired on May 14, 2004.

Segovia had filed a wrongful dismissal suit with the Juzgado de Trabajo de Mayor Cuantía del Segundo Circuito Judicial de San José, which rejected the claim, forcing the Colombian to file his suit to the higher court, the Tribunal de Trabajo, Sección Tercera.

The Tribunal de Trabajo found that the firing had been one of discrimination and ordered the municipality to reinstate Segovia to his position and salary.

The municipality filed an appeal with the Sala II, which found in favour of Segovia.
