Support For Extension Of New Ley De Tránsito

With only fifteen days to go, legislators
are moving closer to the postponement of the
new Ley de Tránsito that is to take effect
on Wednesday 23 September. If approved, the
law would go into effect on March 1, 2010.
The proposal to push back the start of the
law was made by independent legislator,
Andrea Morales, who wants to have the
section numbering corrected in the law that
would bring it into line with the Código
Penal (Criminal Code) and other laws.
The new Ley de Tránsito was approved last
December. However, only the section relating
to drunk and reckless driving went into
force last December, with the balance of the
articles, including the new fines and point
system, to go into effect nine months later.
To effect the postponement the Partido
Liberación Nacional (PLN) - ruling party -
finalized yesterday the filing of the motion
that would allow discussion on the extention.
The PLN proposal would allow the new
sanctions against drunk and reckless drivers
to be applied, while allowing the current
Ley de Tránsito to continue in force until
March.
Jorge Méndez, PLN party whip, assures that
the motion has the necessary support from
legislators for its approval.
Méndez explained that, under the PLN
proposal, a legislative commission would be
established to discuss the reforms to the
law approved last December. If an agreement
cannot be reached by March, the approved law
would go into effect at that time, flaws and
all.
Francisco Antonio Pacheco, president of the
Legislative Assembly, was clear that if the
extension is approved, that there would be
no suspension of the stiff fines for
reckless driving.
Pacheco explained that in no way will the
law go easy on drunk and reckless drivers,
but that the extension is for the good of
the country.
Under the procedures of the Legislative
Assembly, legislators will have another two
days to present motions on the reforms of
the law.
The postponement of the law would also
prevent the 46% increase in the Marchamo
(circulation permit) for 2010, that must be
paid by all vehicle owners by December 31.
