UN Objects Judge Election in Guatemala
UNITED NATIONS - A UN special rapporteur criticized on
Monday, due to lack of transparency and
objectivity, the recent election of judges
to the Guatemalan Supreme Court of Justice.
The objection, published in this
headquarters on Monday, was presented in
Geneva by Gabriela Carina Knaul de
Albuquerque e Silva, special rapporteur for
the independence of judges and lawyers.
According to the UN expert in human rights,
the members of the Guatemalan top judicial
authority were elected in a plenary session,
without establishing a methodology and a
schedule.
The specialist said those are premises to
assess each candidate, in keeping with the
national legislation and the international
standards.
The election held on September ignored the
principles of transparency, objectivity and
experience, which are necessary to this kind
of process, the rapporteur said.
She also regretted that the Guatemalan
Congress did not follow the recommendations
by Leandro Despouy, who was previously
occupying the post of UN special rapporteur
for the independence of judges and lawyers.
Knaul de Albuquerque exhorted to guarantee
that civil society has an effective
participation in electing the judges and
assuring that the Supreme Court counts on
independent, honest and competent judges.
