New Appeal
Seeks To Stop Reinstated Vehicular
Restriction of San Jose
The new vehicular restrictions of San Jose
is in doubt as a "recurso amparo" (appeal)
has been filed with the Sala Constitucional
(Constitutional Court).
The filing was made by Fabio Masís against
government decree 35379-MOPT which permitted
the vehicular restrictions of San Jose to be
reinstated on July 21, after the
Constitutional Court struck down the
previous restrictions on June 12.
Masís argues in his filing that the
Ministerio de Obras Publicas y Transportes (MOPT)
is forcing citizens to seek alternative
transportation methods like public buses to
move about San Jose, causing increased
congestion in this type of transport at a
time when the country suffers from an
increase of infections by AH1N1 virus.
Masís says that it is known to one and all
that Costa Rica is experiencing the terrible
pandemic and the government decree is "an
attack on the principle of protecting public
health".
"I consider that the vehicular restrictions
in the decree can not be contested over the
dangers posed to citizens AH1N1 influenza,
which is already wreaking havoc on our
citizens, and all run the risk of
infection", said Masís in his appeal.
If the Constitutional Court sides with Masís
once again the vehicular restrictions of San
Jose are out and the government has to find
a new way to reinstate, as figures by
transportation officials reveal that the
restrictions have been effective in reducing
congestion of the downtown core. |
