I spent my working life as a contractor and when there were &quot;cost overruns&quot; on my jobs they came out of my pocket, not out of the customer&#039;s pocket.  You make a deal and you live by it, unless you&#039;re a large corporation, in which case you make a deal then you try to extort more money out of the customer.  If the customer finds out you plan on using substandard materials, and delays the job until you agree to use standard or better materials, then it&#039;s your fault for the delay, not the customer&#039;s. In Texas we call those kinds of people s.o.b.&#039;s.  And from construction contracts I&#039;ve ever seen, when there&#039;s a completion delay it&#039;s the CONTRACTOR who pays a penalty, not the one who hired them (i.e. Panama).
