Fundamentally the government argument is this: The so called tip or “propina” is in fact built into every restaurant sales price and therefore is translated as an economic relationship between the establishment and the waiter and not the customer and the waiter. Ergo, why not offer a wage, and then let the client decide the degree of service and how much would be the % of tip? The waiter would (Legally) report the tips while the establishment would report the actual wage and pay Caja, etc. on that only? Certainly a mjaor change in procedure and it would require a lot, but a lot of re-education of both clients and hospitality workers.

@Ken Morris: payroll costs in Costa Rica are 46% of salary. By including the 10% in waiters’ salaries, restaurant owners who follow the rules are being forced to pay an extra 4.6% tax ON SALES, above and beyond the current income tax (which for business is roughly 24% of net profit). Show me another business in Costa Rica which just got hit with a brand new tax on sales. Having just come off four terrible years, thanks to the slowdown in the American economy, the last thing we need is a new tax on sales.

This is actually one I’m for. Rocell makes textbook free-market points, but I don’t think it works that way in real life. If a restaurant can’t afford to pay its portion of payroll tax on its employees’ tips, then it should close IMO. We’re not talking a lot of money here, like 1% of labor costs (which are in turn only about a third of restaurant costs) and the alternative of firing waiters then rehiring them on commission is wide open to abuse. I also don’t agree that quality would suffer or that wait staffs “lack” (John’s point). My impression is that CR culture fosters a friendliness that is exploited by the service sector, and wouldn’t disappear with increased exploitation. Although I must admit that I hope my bartender isn’t on strike, I otherwise say: Go waiters!
