Andy: So love it or leave it, eh? Be sure to remind me of that when you’re sitting in the slammer reading up on the Napoleonic code. Timothy: Suffice to agree that there is no easy solution. Bond is better than preventative detention, but bond is misused all the time in the good ol’ U S of A. There’s no perfect system, that’s for sure. Mary: You probably have it. Hate to “blame the victim” here, but anyone can see that a 50-year-old gringa consorting with a 25-year-old lover and being foolish enough to let him know she was loaded kind of had it coming. Odds are this is how the judge reasoned. My bet is that she’ll get most but not all of it back and the whole case will quietly disappear. If so, justice will probably be done.

How do we know these folks are guilty. It’s refreshing to be in a country where the jails aren’t bursting at the seams. Justice may take too long here but , for my money it’a a lot better than the “hang um high” mentality in the good ole USA.

I thought I read that the police found goods in the possession of the accused linking him to the crime. Doesn’t that constitute en flagrancia? But don’t worry being free the toyboy can convince the woman not to press charges (could be why he was already released). Besides, there’s no room at the jailhouse anyway. Theft of goods in excess of $400,000 doesn’t come near the severity of deadbeat dads.

I was talking with a couple of police officers, I won’t say where or which police force they work with, last week. They had two calls come in during our conversation and didn’t answer either one. I asked them why and they said “we go into harms way every shift and for why? The judges will just let them out if we make an arrest”.

Ken… this is not the USA. You need to read up on Napoleonic Law. That what we have in Costa Rica… like it or not. With that said, the law requires them to stay in jail because they are guilty until proven innocent. If you don’t like it… leave. But I’m with Siegfried… “Is there any hope that the legal system here will ever become effective at protecting law abiding people? I don’t think so.

If the couple have beeen living together for two years, there may be some issues as to who the property “stolen” actually belongs to. This, of course, doesn’t justify the action taken by the accused in the circumstances to re-patriate any personal property, but it certainly could affect who, as between victim and accused, gets to keep what, after a trial.

That said, it is entirely possible that the DA doesn’t believe there is enough evidence to even bring charges, however that would totally contradict what OIJ has said publicly.
