Both have erred for different crimes so don’t fall into the trap of “reverse” judicial activism. You see, that’s what’s wrong when judges have the freedom to make up laws they want to enforce, to whom they want to enforce them, and who they set free according to their own judgement. Besides, think of the publicity backlash if Chinchilla’s husband didn’t have any consequences for his actions — everyone would have a field day.
