3-ring circus court feats

Up
and down we go. Round and round and round and round some more.
Okay.
I’m dizzy now.
With this wide cast of characters, we find ourselves not on a
merry-go-round. It’s more like a roller coaster. We are not
just watching a hamster work out on his wheel. It’s more of
a dog and pony show.
And all well sponsored and brought to you compliments of the
Costa Rican legal and governmental systems.
Enjoy!
And
all while you laugh at it and cry about it at the very same
time.
Philosophically, I am not an optimist, nor a pessimistic.
Rather, I would say that a pragmatic approach (common sense
thinking) would most accurately characterize my world view.
So
it came as a complete shock to me today (March 11) when
we were informed that Osvaldo was to remain behind bars. In
addition – and to clearly add insult to injury –
proceedings are now underway to transfer the 6-7 million from
Enrique’s private frozen accounts to the coffers of the
Fiscal, presumably so that they can use the money in their
fight against him (the legal term for this immorality is pre-confiscation).
So,
my friends, there’s no other way to put it: today was a
double loss for the good guys.
We
had good reason to maintain the hope that things would go
better than they did. The facts seemed to be stacked on our
side. With sound testimony from SUGEF, and with no real
evidence having been presented, how else could Judge Sanchez
logically rule, except in the favor of freeing his prisoner,
and phasing out what has been a futile investigation phase
against the Brothers?
How
else indeed!
Well,
he did. And the war that was first declared last July when those
fireworks flew, will now only continue to rage.
Duke
(and posse) is working to secure the written justifications
behind today’s revelation. They should soon be entered as
part of the record, having been already written out, but being
slow to become entered. As soon as it happens, though, he’ll
get it.
We
are also in close touch with Osvaldo’s attorney, and
planning the usual inroads down at the courthouse to secure
ongoing information as it flows.
This
is all now quite routine for him. What is very troublesome is
that various groups (known and unknown to most of us) will
start to see that they have even more reason to load up their
guns and prepare for vendetta’s and revenge moves against
(depending on who and what they believe) either the Costa
Rican government, their people, or Enrique and family himself.
With
still more precious “wait and see” time lost, it seems
that no one down at Corte Suprema wants to listen to
reason; places like neighboring Nicaragua look better and
better, and, more and more are feeling they are running out of
time.
What
happens next? Well, we can tell you first-hand (and
thankfully!) that Enrique is engaged, and currently evaluating
his next moves. We also suspect that we will see some serious
changes in strategy in the next week or two.
Enrique
being thus “engaged” does not mean that he left his wife
and is promised to another. No, this is just Duke’s way of
saying that he is “in on” what is happening, and actively
involved in what will be taking place next, in response to
this newest of a string of legal setbacks.
Unlike
an umbrella drink-sipping gambler on the other side of town,
our man Enrique keeps a calculating awareness of what is going
on.
He
cares. He has not given up.
As
a reminder, yes it’s true that he does not contact you by
phone or by e-mail. If you do not understand the reasoning
behind this, then you are simply not being very empathetic.
That he cannot deliver regular messages and correspondences
should be just about equally understandable.
But
now that we are at or near the end of the legal rope, we
should see some strategy changes coming.
What’s
that mean? Who knows…we don’t have the crystal ball that
well polished! But just remember that it was said.
I
personally am very sorry for instilling hope in so many of you
with my recent articles that talked about breaks coming our
way in the near future. The common sense thing would have been
to conclude that this was happening – it did not.
The
law of averages seems to always work against us when it comes
to these people who are running things in this legal system
and government. Others and I have made the mistake of thinking
that reason and a higher logic would prevail, and with these
people, it repeatedly does not do that.
It’s
sure to come to pass that some of the drastic measures
threatened in the past will now begin to come to light.
Don’t
forget: plenty of money is behind those who invested with
Enrique. Not everyone was cleaned out. A handful of these
people will be heard from again, most likely indirectly, and
it may prove to be a grievous thing…
The
average person in this country (wonderful men and women that
they are) has already suffered, some a lot, some a little,
from this. By now, this has become more and more a matter of
known reality.
Many
of them will now suffer even more as this thing drags on and
on still more. With today’s revelations, we’ve at least
been set back two months.
And
then there’s the question of how long don Enrique can keep
his business intact when they continue to drag him through
this mess? How long could anyone do this kind of thing, given
these circumstances?
To
those vocal few who actually blame Enrique for all of this, I
would ask now if you cannot see how the courts and the
system has kept this thing going for so very long now?
…As
we wind down with the legal options, and as I suggested a
moment ago, look for Enrique’s strategy to undergo a
significant change. He’s not giving up; still more is in the
works as we speak.
He’s
tried to do it by the numbers, to go by the book.
Don’t
be surprised, now, if the book gets thrown out the window…
