Burgos Asks For A
Re-Trial
Luis Fernando Burgos,
the former public
defender found guilty
and sentenced to 35
years prison for killing
his wife, Mauren
Hidalgo, may get another
day in court as the
Corte Suprema de
Justicia or Sala III has
decided to accept new
evidence in the closed
case.
Burgos, at a hearing of
the Sala III, presented
evidence of a plot
against him by officials
of the Poder Judicial,
especially by the Fiscal
General (Chief
prosecutor), Francisco
Dallanesse, and the
coordinadora de jueces
de San José, Elizabeth
Tossi, who exchanged at
least two telephone
calls before the trial
began.
In addition, Burgos, is
insisting that one of
the trial judges, Linda
Casas, was present at
Mauren's funeral and his
proof is on video.
Mauren was only an
employee of the Poder
Judicial.
Burgos, in his
arguments, insists that
the prosecution did not
present proof and
witnesses that could
have been fundamental to
the judge's decision in
the trial that ended in
September 2007.
Defence attorneys have
requested that the
sentence be put aside
and a new trial ordered.
The final decision on
the request will be made
by the Magistrates of
the Sala III in the near
