Directory War As ICE
Takes Action Against
Competition in Yellow
Pages Directory
The company Telefónica
Amarilla responsible for
publishing the 2008 "paginas
amarilla" (yellow pages
directory) in direct
competition with the
Instituto Costarricense
de Electricidad's (ICE)
paginas amarilla must
suspend distribution of
its directories at once.
ICE complained that
Telefónica Amarilla
infringed its trademark.
The order comes from the
Tribunal Procesal
Contencioso
Administrativo del
Segundo Circuito
Judicial de San José
following a complaint
filed by ICE last week.
Geovanni Bonilla, ICE's
legal director, says
Telefónica Amarilla is
using ICE's trademark
illegally, in that the
publication and
distribution of the
yellow pages is the
exclusive right of
Radiográfica
Costarricense (Racsa), a
ICE subsidiary.
Racsa was given the
contract to publish the
white and yellow pages
telephone directory
after ICE cancelled a
contract with Verizon in
2006. Verizon had been
publishing the directory
for years and Costa Rica
was left without a
telephone directory -
white and yellow pages -
in 2007, following the
Verizon cancellation.
The complaint by ICE
and the court decision
is only the first step
in the process,
according to Bonilla,
who said that ICE will
now be looking for
damages.
Elberth Durán, a
spokesperson for ICE,
said that the
Institución will be
maintaining a firm line
on its defense of
trademarks and corporate
image.
For the time being
Telefónica Amarilla has
not made any comment on
the court decision.
